These documents formalise a contractual relationship between you and SCB Group serving, in particular, as a legal basis for the collection and processing of your personal data by SCB Group under the conditions of this Confidentiality and Privacy Policy.
In addition, the execution of (pre)contractual relations that are binding on us, at your initiative, requires the performance of a number of processing operations whose purposes are detailed in paragraph II - 4. For what purposes is your Personal Data used?

It allows you to learn more about the origin and use of information and Personal Data collected and processed by us during your consultation of our Website, or the use of our Services (as defined below) and to inform you about your rights, in particular your Specific Rights.
This Policy is therefore important for you, who wants to have a positive and confident experience of our Services and for SCB Group who wants to accurately and fully answer your questions about your consultation of our Website and the use of our Services, and take your wishes into account.
We may freely modify this Confidentiality and Privacy Policy. Any changes will take effect immediately and will only apply to Members using the Site after the change. Therefore, we invite you to refer to it on each visit to our Site, to read its latest version permanently available on the Site.
I – Glossary
For the purposes of this Confidentiality and Privacy Policy, including its preamble, capitalised terms, whether used in the singular or plural, that are not defined in any of our contractual documents listed above, have the following meanings:
" Intermediate archiving ": means the isolation of Personal Data which is still of administrative interest to SCB Group (such as, for example, to fulfil our accounting obligations) through a logical separation (management of access rights and access limited to a specific service) and/or physical separation. This archiving is an intermediate step before the deletion or anonymisation of your Personal Data concerned.
" Order": means each purchase or reservation of goods and/or services by a Member on the SCB Group Site under the conditions laid down in the GCS , possibly supplemented by special conditions.
" Cookies": means the tracers and/or equivalent technologies, i.e. in particular cookies, "Flash" cookies, resulting from the "fingerprinting" calculation of your Terminal, local web storage, web beacons, used alternatively or in combination to i) facilitate the Member's browsing (Browsing Cookies), ii) propose products and services tailored to the Member's areas of interest (Advertising Cookies), iii) allow the development of statistics (Audience Cookies) and iv) allow the Member to access personalised products and services on the Site or via messages sent by SCB Group (Personalisation Cookies) and allow interaction with Social Networks (Social Networks Cookies), etc.
" Personal Data " or " Data": means any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, identification number, location data, online identifier, or one or more elements specific to his physical, physiological, genetic, psychic, economic, cultural or social identity. Thus, the data we collect may include your strictly personal data, in that it makes it possible to identify you as a particular person. Conversely, some data does not allow us to identify you directly, such as your profession or your browsing data (the type of browser, Terminal and operating system, the path followed on the Site, etc.) but is still considered as Personal Data as it is attached and/or attachable to the first;
" Third-Party Data ": means the Data that we share, if any, with third parties under the conditions determined in particular in Article II-7.2 .
" Specific Rights": means the rights granted to the Member by the Personal Data Regulations and in particular the rights of:

- rectification (Article 16 of the GDPR),
- erasure (Article 17 of the GDPR),
- limitation of processing (Article 18 of the GDPR),
- portability (Article 20 of the GDPR),
- opposition (Articles 21 and 22 of the GDPR),
- post-mortem instructions (Law No. 78-17 of January 6, 1978 on computers, files and freedoms);
These Specific Rights and the means of exercising them are specified in paragraph III- Your rights.
" Member(s)": means any user who has entered Personal Data on the SCB Group Site registration form, accepted the GCU , and the Confidentiality and Privacy Policy and who, after receiving a confirmation email, has definitively validated their SCB Group account.
" Partner(s)": means the different services providers of SCB Group, whether for the processing of your Orders, the delivery of products, the after-sales services, the provision of technological or advertising services, the Social Networks (as defined below), etc., or more specifically our suppliers for sales of products and/or services on the Site, including as necessary the SCB Group.
" Personal Data Regulations": means, together, the GDPR, Law No. 78-17 of January 6, 1978 on computers, files and freedoms as amended and any new law, decrees implementing it.
" GDPR": means the General Data Protection Regulation No. 2016/679 of April 27, 2016 applicable as of May 25, 2018 or, instead, any law that may be adopted for the transposition of said Regulation.
" Services": refers to the definition given in Article 3 of our GCU.
"Site(s)" or" SCB Group Site(s)" : means the websites published by SCB Group in their web and mobile version, and the corresponding mobile applications, in particular the SCB Group website, accessible at www.scbmarket.com.
" Terminal(s)": means the hardware equipment (computer, tablet, smartphone, telephone, etc.) that you use to consult or view the Site and/or any other digital medium published by a third party.
" SCB Group ": means the publisher of the Site as designated in our legal notice.
" SCB Group ": means the companies that SCB Group directly or indirectly controls, within the meaning of Article L.233-3 et seq. of the Commercial Code, including in particular SCB Group.
II - The protection of your Personal Data
All the information that you provide to SCB Group and/or to the SCB Group during your visits to our Site is strictly confidential.
II - 1. What is the legal basis for the processing implemented?
In accordance with the Personal Data Regulations, the processing referred to in this Confidentiality and Privacy Policy are supported by a specific legal basis.
II - 1.1 Consent of the Member to one or more specific purposes
SCB Group has requested your express consent to communicate some of your Personal Data to its Partners and to use your Personal Data to provide you with promotional offers tailored to your browsing.
The details of this processing are provided in paragraph II - 5. What is the benefit of seeing promotional offers adapted to your browsing?
You can withdraw your consent at any time by expressing your choices in paragraph VIII - Express your choices.
II - 1.2 Processing necessary for the execution of your contractual relations with SCB Group To use the Site and benefit from the Services, you have accepted the GCU , as well as, if applicable in case of the purchase of product(s) and/or service(s), the following documents:

These documents formalise a contractual relationship between you and SCB Group serving, in particular, as a legal basis for the collection and processing of your Personal Data by SCB Group.
This Data is necessary to perform a number of processing operations related to the execution of your contractual relationship and whose purposes are detailed in paragraph II 4. For what purposes is your Personal Data used?
II 1.3 Processing necessary to comply with a legal obligation imposed on SCB Group;
The processing we carry out may also be dictated by a legal obligation imposed on us. This is the case, for example, of Decree No. 2011-219 of February 25, 2011 relating to the retention and communication of data making it possible to identify any person who contributed to the creation of online content.
II - 1.4 Processing necessary for the legitimate interests pursued by SCB Group
SCB Group may have a legitimate interest justifying the processing of your Personal Data (e.g.: the processing of your Data strictly necessary for the purposes of prevention of fraud in accordance with paragraph II - 6 Fight against fraud )
In this case, SCB Group makes sure that the processing in question is indeed necessary for the pursuit of its legitimate interests and assesses the consequences of this processing for the Member, in particular taking into account the nature of the Data processed and the ways in which it is processed.
The purposes of the processing carried out by SCB Group are detailed in paragraph II 4. For what purposes is your Personal Data used? and II 5. What is the benefit of seeing promotional offers adapted to your browsing ? .
SCB Group spontaneously gives its Members the opportunity to oppose certain processing of their Personal Data in paragraph VIII Express your choices.
If a Member wishes to object to the processing of his Personal Data for which a button has not been provided by SCB Group, he can still exercise his right of opposition under the conditions of paragraph III Your rights.
Indeed, we make sure not to disregard your interests or your fundamental rights and freedoms by allowing you, at any time, to object to all or part of the processing operations described in this Confidentiality and Privacy Policy, how to implement your Specific Rights, under the conditions of paragraph III Your rights.
II 2. What Personal Data is collected?
SCB Group collects the Data that you voluntarily provide it with from a collection form on the Site, in particular at the time of your registration as a Member or of an Order, including socio-professional information (your profile, i.e. your surname, common name, first names, gender, date of birth, sponsor and/or sponsorees, delivery address, profession, for example) which SCB Group associates with a Member number.
During an Order, our banking providers also collect and process Personal Data concerning your means of payment (credit card number, expiry date of the credit card, visual cryptogram, which is not kept, etc.). As for us, we process the partial number of your bank card consisting of the first six (6) and last four (4) numbers and the expiry date of your credit card as transmitted by your bank. This payment identifier therefore does not make it possible to perform a bank transaction and is kept for fifteen (15) months, unless you delete it from your Member account.
We also collect information about the transaction (transaction number, purchase details, etc.), or the payment of invoices issued from or via the Site (payment terms, discounts, receipts, balances and unpaid amounts, or relating to loans taken out, amount and duration, name of the lender, etc.).
Some Data is mandatory and some optional, as indicated in the collection form on our Site.
SCB Group collects and/or receives from its Partners and processes Data relating to the monitoring of the commercial relation with you: product and/or service purchased, service or subscription purchased, quantity, amount, periodicity, delivery and/or billing address(es), telephone number, digicode, as well as any other relevant delivery information (tracking numbers, shipment status, etc.), history of purchases and services, product returns, correspondence and/or telephone exchanges with you and our after-sales service, Members' exchanges and comments, person(s) in charge of the customer relation, etc.
We also collect and process the Data necessary to i) carry out loyalty, prospecting, study, survey, product testing and promotional actions, ii) to organise and process contests, lotteries and any promotional operation such as the date of participation, the answers given to contests and the nature of the prizes offered, iii) Data relating to the contributions of Members who post opinions on products, services, content, the Services or the Site.
We also collect the Data necessary to store your preferences in terms of communication (channel, content and frequency) and display the sales entered on the forms of the Site.
In addition, when you access the Site and/or an electronic medium published by a third party containing promotional campaigns disseminated by the SCB Group, Cookies are likely to be used and/or deposited, which register and/or read files on your Terminal, including by our Partners and/or those of the SCB Group, to collect and process information relating to your interaction with our Services, and in particular your browsing and behaviour on the Site.
SCB Group therefore collects and processes Data relating to your browsing and your behaviour on the Site, which takes many forms: your IP address, the pages visited, the brands that interest you, the purchases made, etc.
Within this framework, subject to your agreement (see Articles VII and VIII below) which may also be expressed by the configuration of your Terminal, SCB Group may also collect and process all or part of the following Data:
- Information related to the Terminal that you use:
- The type of Terminal you use (Smartphone, tablet, computer, etc.);
- The operating system of your Terminal (Mac OS, iOS, Android, Windows, BlackBerry etc.);
- The plug-in categories and versions of your Terminal;
- Your Internet service provider (Orange, SFR, Bouygues, Free, etc.);
- The browser used (Safari, Chrome, Internet Explorer, etc.);
- The advertising identifier linked to the operating system of your Terminal;
- The IP address of your Terminal;
- The geolocation data of your Terminal;
- Your language preferences.
Information about your browsing and your behaviour on the Site
- statistics on the consultation of the different pages of our Site (such as the category of goods or services presented on the pages you visit, the time you spend on them, their time stamp, etc.);
- the complete URL path to, via and from our Site;
- confirmation of receipt and reading of commercial, prospecting or information emails that we have sent you, provided, where applicable, that you have previously agreed.
Information on the sales spaces and/or promotional banners you access on the Site, and on the media of third parties, the promotional advertisements sent to you and, if applicable, that have been sent to you:
- The URL and/or subject of the website and/or mobile application where you have browsed and where the promotional advertisement may be issued to you and, if applicable, has been issued to you;
- The detail of the advertisement(s) that are sent to you and, if applicable, have been sent to you (identity of the advertiser, type of advertisement, etc.);
- Your behaviour with respect to this/these advertisement(s) (time spent on advertising, your potential clicks, etc.);
- Your behaviour after clicking on the advertisement(s) (downloading an application, answering a questionnaire, etc.);
- The number of times you have received the promotional advertisement(s) delivered.
Information about you (age or age group, gender, declared and/or presumed socio-professional category, presumed interests, etc.) related to your activity on the Internet and/or on the Site (depending on the pages visited, products viewed, searches performed, etc.).
We may allow you to share information about our Services on the websites (in their fixed or mobile version, including the corresponding applications) of social networks (Facebook, Twitter, etc.) of our Partners (hereinafter the " Social Networks "), in particular through share buttons, the use of said Social Networks, in particular to facilitate the creation of your Member account or to associate your Member account with your personal account on the Social Networks, in accordance with Article VI below.
SCB Group collects and processes the Data resulting from the configuration of your Member account, such as the frequency and/or time of receipt of the announcements of our sales, our newsletters, our alerts, etc.
Finally, SCB Group may combine all or part of this Data, which is likely to generate new Personal Data even if it is of a strictly interpretative origin. You can exercise your right to access this Data at any time, according to the terms and conditions of paragraph III 2. How do you exercise your rights?
II 3. How long is your Personal Data kept by SCB Group?
Your Personal Data regarding your Member profile as you have declared and/or completed on the Site, as well as that concerning your browsing and/or behaviour on the Site and the promotional advertisements displayed both on the Site and on third-party media by our Partners and/or those of the SCB Group, is kept, in an active database, for a period of three (3) years from your last activity on the Site or on an electronic communication medium (in particular an email) of the SCB Group as a Member. At the end of this period, your Member profile is considered "inactive" and will be automatically disabled. You will therefore have to create a new one for any new Order.
However, audience measurement statistics and your raw Site visit data are not kept for more than thirteen (13) months.
Your Personal Data in relation with an Order on the Site (surname, first name, product or service, delivery/billing address, etc.) is kept for a period of three (3) years following an Order. It remains accessible by you and by us, in particular from your Member account, to allow you and us to have a complete history of your Orders. We can delete it at any time on request from you.
However, at the end of these periods, including where applicable from the date of your deletion request, your Personal Data may be subject to intermediate Archiving to meet our legal, accounting and tax obligations (such as the ten-year retention obligation for invoices set out in Article L.123-22 of the Commercial Code) and/or at least during the applicable limitation period (such as the limitation period under common law of five (5) years enshrined in Article 2224 of the Civil Code), but also to prevent any possible illegal behaviour after the deletion of your Member account (reuse of your old account by a third party, for example) or to respond to your requests after your Member account has been closed, including those regarding Orders, etc.
In case of litigation, including that only concerning SCB Group\, for example with respect to the administration, the aforementioned Personal Data as well as any information and documents containing Personal Data to establish the facts likely to be reproached or concerning the identification of the persons involved, victims, witnesses and legal officers (surname, common name, first names, gender, date and place of birth, nationality, address, telephone and fax numbers, email address) can be kept for the duration of the proceedings, including for a duration longer than those indicated above.
II 4. For what purposes is your Personal Data used?
The operations described below are not used to establish profiles likely to reveal sensitive Personal Data such as racial or ethnic background, philosophical, political, trade union, religious opinions, sexual life or health.
Your Personal Data is necessary to allow you access to our Services, their use and their improvement, and to enable us to:
- perform operations relating to our commercial relationship, i.e. concerning your registration to the Services (in particular verifying the veracity of your email), Orders, deliveries, invoices, accounting, monitoring of the " customer relationship " with a Member, such as conducting satisfaction surveys, claims and after-sales service management, refunds, specific commercial gestures, returning Orders, exercising your right of withdrawal, etc.;
- offer you commercial offers close to your geographical location, especially in the context of so-called "Near me" offers through the "In-store collection" service;
- select Members to carry out studies, surveys and product tests, as well as loyalty, prospecting and promotional actions;
- carry out prospecting operations, i.e. the management of technical prospecting operations (which includes technical operations such as standardisation, enrichment and deduplication);
- the performance of commercial solicitation operations;
- the development of trade statistics, analysis and marketing tools (including classification, score, etc.);
- the organisation of contests, lotteries or any promotional activity other than online gambling subject to the approval of the Online Games Regulatory Authority;
-the management of requests for the exercise of the Specific Rights specified in Article III below;
- the management of non-payments and litigation;
-the management of your comments on the Website and/or on the web pages published by us and hosted on the websites of our Social Networks;
-the fight against fraud and in particular to reduce the triggering of the 3D Secure protocol when Members pay according to the evaluation of the Terminals, verification of the transactions and Order returns (see II-6 below).
More specifically, the Personal Data collected from the Cookies that we and/or the SCB Group, or our Partners, deposit on your Terminal under the conditions of Article VII allows us to:
- establish statistics and volumes concerning the number of visits and use of the various elements of our Site (sections and contents visited, journeys), allowing us to improve the interest and the ergonomics of our Services;
- adapt the presentation of our Site to the display preferences of your Terminal (language used, display resolution, operating system used, etc.) during your visits to our Site, depending on the hardware and visualisation or reading software that your Terminal contains;
- memorise information relating to a form that you have filled in on our Site (registration or access to your account) or Orders (service subscribed, contents of a shopping cart, etc.);
- allow you to access the reserved and personal areas of our Site, such as your account, by means of identifiers or Data that you may have previously entrusted to us;
- implement security measures, such as when you are asked to sign in again to a content or Service after a certain period of time;
- count the number of displays and activations of our sales areas and/or promotional offers, including on electronic media published by third parties and/or Partners, to identify these contents and media, to determine the number of users having clicked on each content;
- calculate the sums possibly due to our Partners of the advertising chain (communication agency, advertising agency, dissemination site/medium) and to establish statistics;
The combination of your Data is also useful to facilitate, specify, anticipate the processing operations whose purposes are recalled above and below.
II - 5. What is the benefit of seeing promotional offers adapted to your browsing?
Subject to your consent, your Personal Data is also necessary to enable us to:
- propose offers of Partners and/or the SCB Group according to your choices;
- personalise our Services, in particular by personalising the Site according to your perceived and/or declared and/or suggested preferences and your needs;
- personalise our communication to your attention, including information emails, based on your perceived and/or declared and/or suggested preferences, your needs and your choices;
More specifically, the Personal Data collected from the Cookies that we and/or SCB Group, or our Partners, deposit on your Terminal under the conditions of Article VII allows us to:
- adapt the presentation of the Site which leads to one of our sales areas and/or promotional offers:
- according to the display preferences of your Terminal (language used, display resolution, operating system used, etc.) during your visits to our Site, and depending on the hardware and visualisation or reading software that your Terminal contains;
- according to the location Data (longitude and latitude) that is transmitted to us (or to our Partners) by your Terminal with your prior agreement.
- according to your customer profile.
- monitor the subsequent navigation carried out by your Terminal on our Site and/or electronic media published by Partners.
Subject to your consent and under the conditions of Article II - 7, all this Data also allows us to provide you on the media of third parties and/or Partners with relevant and personalised advertising for products or services that may be of interest to you, in particular depending on your browsing behaviour. To this end, we use the Google Adwords functionality developed by the company Google. This functionality allows us, through Google Cookies on your Terminal, subject to your consent expressed via our Cookies management tool, to collect and use Personal Data for the personalization of the offers on the Site. To learn more about the Google Adwords functionality, the communication and use of your Personal Data by Google, click here . The Data collected in this last case may also be used for the purposes of reporting on the performance of the promotional operations implemented.
Our goal is to present you with the most relevant offers possible on our Site and, if necessary, on third-party media. To this end, the Cookies technology makes it possible to determine in real time which offer to display on a Terminal, according to your recent navigation on Internet.
You no doubt prefer to see offers of products and services that correspond to what you are interested in, rather than offers that are of no interest to you.
However, if this is not the case, you can always exercise your right of opposition in paragraph VIII - Express your choices.
II - 6 Fight against fraud
SCB Group is convinced of the need to take measures against fraud that endangers consumers and their trust in online commerce.
To ensure the security of payments during transactions on our Site, avoid fraud and thus protect consumers in the context of distance selling, SCB Group may be required to carry out an automated processing of Data whose purpose is to control Orders and/or to have them controlled by its Partners, and to check the accuracy of the information transmitted to it during these transactions. This verification involves a processing of Personal Data collected through the Site.
Therefore, if an Order does not present, or does not seem to present all the necessary guarantees to ensure a compliant and secure payment, SCB Group reserves the right to cancel the Order. SCB Group and/or its Partner(s), if it/they consider it necessary, may ask you for additional information and documents to finalise the Order.
If the Order is not paid within the time limit, SCB Group may be forced to cancel the Order and to record some of your Personal Data in a " payment incidents " file. In this case, the Member concerned will be informed by email when the incident leading to his inclusion in this file occurs. This email will specify in particular the reasons and consequences of this inclusion and how to exercise the Specific Rights. As soon as the Member's payment is received by the SCB Group Recovery Service, his Personal Data will be deleted from the aforementioned file and the Order process reactivated. Until then, the Personal Data contained in the " payment incidents" file (in particular the IP addresses used by the Member) will be shared with the SCB Group as needed, to prevent any further Order, up to two (2) years after the incident giving rise to the suspension, unless the incident at the origin of the report is closed, subject to an additional storage in the Intermediate Archives.
More generally, any fraudulent behaviour of a Member on the Site, in particular with regard to the GCS, may result in the suspension, including as a precautionary measure, of the Member's Account and the inclusion of some of his Personal Data in a corresponding file. In this case, the Member concerned will be notified by any means, as well as how to exercise the Specific Rights.
As soon as the Member's payment is received by the SCB Group Recovery Service, his Personal Data will be deleted from the aforementioned file and his Member account reactivated. Until then, the Personal Data contained in the " suspension as a precautionary measure" file (in particular the IP addresses used by the Member) will be shared with the SCB Group as needed, to prevent the creation of any new Account, up to three (3) years after the incident giving rise to the suspension, unless the incident at the origin of the report is closed, subject to an additional storage in the Intermediate Archives.
II - 7 What information do we share with third parties?
All your Personal Data that has been collected by SCB Group is strictly confidential.
SCB Group will never transmit your Personal Data to any third party likely to use it for its own purposes, and in particular for commercial and/or direct advertising purposes, without your express consent.
However, SCB Group may communicate your Personal Data to respond to an injunction of the legal authorities.
II-7.1 SCB Group may be required to temporarily and securely transfer to third parties (Partners, SCB Group), some Personal Data which is necessary in particular for the operation, coordination and maintenance of our Site, to send the emails you have chosen to receive and/or perform tasks necessary for the execution of Services, your Order, to ensure the delivery of goods, the performance of services and/or the reservation of certain goods in store, to fight against fraud and more generally any criminally punishable activity, for certain aspects of the after-sales service and to carry out satisfaction surveys, etc.
In fact, some Data relating to our sales dedicated to eroticism for example, or to products or services reserved for adults, is collected. However, SCB Group only communicates to its Partners concerned and/or to the entity(ies) of the SCB Group concerned the Data declared at the time of a purchase on these specific sales and strictly necessary to complete the sale and its delivery, as well as, if applicable, the after-sales service.
The browsing and/or behavioural Data relating to this type of sale is not communicated.
Our Partners concerned and/or the entity(ies) of the SCB Group Group who may have access to your Data processes it on our behalf, according to our instructions, in accordance with this Confidentiality and Privacy Policy and any appropriate security and privacy measures.
In this respect, when these Partners are located outside the European Union, or in a country which does not have adequate regulations within the meaning of the Personal Data Regulations ( https://www.cnil.fr/fr/la-protection-des-donnees-dans-le-monde) , we govern our contractual relationship with this Partner by adopting an appropriate contractual mechanism (see II-8)
II-7.2 Among the companies of the SCB Group recipients of your Personal Data, Adotmob may be required to process your Data, if you have consented.
Adotmob buys, in real time, on electronic media published by third parties (websites in their fixed and/or mobile versions, including applications), advertising spaces in the name and on behalf of advertisers, including SCB Group, depending on the profile of the internet user/mobinaute (including Members), the profile established in particular on the basis of the Personal Data communicated to Adotmob by the publisher of said medium and/or its Partners (hereinafter referred to as " Third-Party Data") as well as by SCB Group.
The Personal Data communicated by SCB Group and/or by the SCB Group to Adotmob, in particular following the deposit of one of its Cookies on your Terminal from our Site, crossed and/or combined with the Third-Party Data, will therefore allow Adotmob to identify you when you browse an electronic medium published by one of its Partners, as a Member of the site, but also to know your preferences as identified by SCB Group. This Data is associated with an identifier that varies depending on the browser and mobile application environments you use (IDFA for applications and Cookies for web and mobile desktop). Adotmob may therefore use the results of this crossing of Personal Data to send you targeted advertising on an electronic medium published by its Partner, but also communicate these results to SCB Group.
If you have not given your consent on the Site to receive the targeted advertising of third parties on third-party media, Adotmob may nevertheless, if appropriate, disseminate on said media for your attention, on the electronic media concerned, advertising only for SCB Group.

II - 8. Hosting your Personal Data
The Internet is a publicly accessible global computer network composed of millions of public and private networks through which information travels. As a result, even before arriving on our servers in France, the Data coming from your Terminal has already passed through servers located around the world, irrespective of any action of SCB Group.
The Site is accessible across different countries but your Data is only stored on secure servers located in France, or at least in the European Union. In order to operate certain Services and features on the Site, SCB Group (and/or its subcontractors within the meaning of the Personal Data Regulations) may be required to transit the Data through its servers and/or those of its Partners who may be located throughout the world and/or host Data in countries that have laws that provide a level of data protection that is either in line with the Personal Data Regulations, or different.
In any event, SCB Group naturally takes the appropriate steps to maintain an adequate level of confidentiality and security of your Personal Data during its transfer and receipt, contractually requiring of all its subcontractors and service providers that they implement any appropriate technical and organisational measures, on an ongoing basis, to secure the Personal Data and provide it with the same level of protection as that required by the Personal Data Regulations.
These Partners are bound by contract with SCB Group, which includes contractual clauses relating to the regularisation of these transfers of Personal Data in accordance with the Personal Data Regulations, for example standard contractual clauses (as published by the European Commission) and ensures in particular a high level of Data protection confidentiality. SCB Group requires all its subcontractors and service providers to implement any necessary technical measure, on an ongoing basis, to keep Personal Data secure and ensure the same high level of protection of Personal Data as that required by the Personal Data Regulations.

III - Your rights

III - 1. What are your rights?
In accordance with the Personal Data Regulations, you have the following Specific Rights:

You have the option to obtain from SCB Group confirmation that the Data concerning you is or is not processed and, when it is, access to said Data as well as the following information:

c) the recipients or categories of recipients to whom the Data has been or will be communicated;
d) when possible, the intended Data retention period or, when this is not possible, the criteria used to determine this period;
e) the existence of the right to request SCB Group to rectify or erase Data, or a limitation of the processing of your Data, or the right to oppose such processing;
f) the right to lodge a claim with the CNIL;
g) when the Data is not collected from you, any information available as to its source;

When the Data is transferred to a third country or an international organisation, you have the right to be informed of the appropriate guarantees with respect to this transfer.
SCB Group provides a copy of the Data that is subject to processing.
SCB Group may require the payment of reasonable fees based on the administrative costs for any additional copy requested by the Member.
When you submit your request electronically, the information is provided in a commonly used electronic form, unless the Member requests otherwise.
Your right to obtain a copy of your Data must not affect the rights and freedoms of others.
III - 1.2 Rights of rectification
You have the possibility to obtain from SCB Group, as soon as possible, the rectification of Data concerning you which is inaccurate. You also have the possibility to have incomplete Data completed, including by providing a supplementary declaration.
III - 1.3 Rights to erasure
You have the possibility to obtain from SCB Group the erasure, as soon as possible, of Data concerning you when one of the following reasons applies:
a) the Data is no longer necessary for the purposes for which it was collected or otherwise processed by SCB Group
b) you have withdrawn your consent to the processing of such Data and there is no other legal basis for the processing;
c) you exercise your right to object under the conditions set out below and there is no compelling legitimate reason for the processing;
d) the Data has been unlawfully processed;
e) the Data must be erased to fulfil a legal obligation;
f) the Data was collected from a child.
III - 1.4 Rights to limitation
You have the possibility to obtain from SCB Group the limitation of the processing of your Data when one of the following reasons applies:
a) SCB Group verifies the accuracy of the Data following your challenge of the accuracy of the Data,
b) the processing is illegal and you oppose the erasure of the Data and require instead the limitation of its use;
c) SCB Group no longer needs the Data for the purposes of processing but it is still necessary for you to ascertain, exercise or defend legal rights;
d) You have objected to the processing under the conditions described below and SCB Group checks to see if the legitimate reasons pursued prevail over your alleged reasons.
III - 1.5 Right to Data portability
You have the possibility to receive from SCB Group the Data concerning you, in a structured format, commonly used and readable by machine when:
a) the Data processing is based on consent, or on a contract and
b) the processing is performed using automated methods.
When exercising your right to portability you have the right to have the Data sent directly by SCB Group to a data controller you designate, when this is technically possible.
Your right to the portability of your Data must not affect the rights and freedoms of others.
III - 1.6 Right of opposition
You have the right to object at any time, for reasons relating to your particular situation, to a processing of your Data based on the legitimate interest of SCB Group. SCB Group will no longer process the Data unless it demonstrates that there are legitimate and compelling reasons for the processing that prevail over your interests and your rights and freedoms, or may retain it for the purpose of the ascertainment, exercise or defence of rights in court.
When the Data is processed for prospecting purposes, you may object at any time to the processing of such Data in paragraph VIII - Express your choices .
If a Member wishes to object to the processing of his Personal Data for which a button has not been provided by SCB Group, he can still exercise his right of opposition under the conditions of paragraph III - Your rights.
III - 1.7 Post-mortem instructions
You can provide us with instructions regarding the retention, deletion and communication of your Personal Data after your death. These instructions can also be recorded with a " certified digital third party". These instructions, or a kind of " digital will", may designate a person responsible for their execution; otherwise, your heirs will be designated.
In the absence of any instructions, your heirs may contact SCB Group to:
- access Data processing allowing " the organisation and settlement of the estate of the deceased";
- receive communication of " digital assets" or " data akin to family souvenirs, transmissible to heirs";
- have your Member account on the Site closed and oppose further processing of your Personal Data.
In any event, you can inform us, at any time, that you do not wish, in case of death, that your Personal Data be communicated to a third party.

If necessary, this period may be extended by two months by SCB Group which will notify you, depending on the complexity and/or number of requests.
In the event of a request to delete your Data and/or if you exercise your right to request the deletion of your Data, we may however retain it in the form of intermediate Archiving, for the duration necessary to meet our legal, accounting and tax obligations and, in particular, to prevent any possible illegal behaviour after the deletion of your account (reuse of your old account by a third party), in accordance with Article II-3 of this Confidentiality and Privacy Policy.
It is specified as necessary that the request to delete your Member account from the Site is not interpreted by SCB Group as an express request to exercise your right to oppose, limit or delete for legitimate reasons. Your Member account is thus rendered inactive and the Data concerning you is the subject of Intermediate Archiving under the conditions and for the durations indicated above.
You can also choose the types of emails that you want to receive or not, by going to the "My communications" section. You will thus be able to unsubscribe, permanently or temporarily, from each category or from all the emails.
An unsubscribe link is also included in each email that SCB Group sends you.
You may also at any time ask to stop receiving advertisements or surveys adapted to the browsing information of your Terminal, by contacting us directly and free of charge, or by using the unsubscribe link included in any prospecting we send you by email. In this case, advertisements that you may continue to receive, unless you exercise your right to object, will no longer be adapted to the browsing of your Terminal.
You may, at any time, make a claim to the competent supervisory authority (in France, the CNIL: www.cnil.fr )
IV - Secure browsing on the Internet
IV - 1. Integrity of your Data on the Internet
We implement effective means to ensure that your Data is secure. This is why we use control measures that are technical, physical and procedural which are implemented at the time of collection, processing and transfer of your Data.
The security of the Site is the daily work of teams dedicated to this specific matter.
To provide our Members with the necessary security while maintaining the usual browsing comfort, several mechanisms have been implemented.
Connection to our Site is carried out via a secure connection using SSL (Secure Socket Layer) technology. Access can only be gained by entering your Member ID and password, which are personal to you.
IV - 2. Malicious use
Nevertheless, you must protect the password of your account and not communicate it to anyone.
To do so, your password must consist of at least 8 characters and a special character, not be composed of the surname, first name or an email address used for your registration. After four unsuccessful attempts, the account will be blocked.
You must also be careful and use good judgement when using one of our community spaces, including those managed by our Partners, such as the social networks: no employee of SCB Group will ask you for your password.
We also recommend that you do not disclose information that can identify you or identify a third party. If you do, we cannot be held responsible on this account. In addition SCB Group asks you to contact us immediately if you discover an unauthorised or suspicious use of your Data in connection with SCB Group by writing to us at the email address spoof@scbmarket.com.
Your password and the links to the Site sent in our emails are for your sole attention, and are confidential.
The emails received from SCB Group, the connection links they contain and your passwords must never be transmitted to other people, to avoid any risk of identity theft.

Apart from SCB Group to which you have voluntarily transmitted your Data and in particular your email address and account, given the nature of the Internet, other operators, who have no connection with SCB Group, are able to capture this Data without your consent, in particular when you browse the Internet. Accordingly, we recommend that you install anti-virus and anti-spyware software and update them regularly.
Indeed, although the SCB Group infrastructures are protected from malicious software called "malware" (viruses, trojans, worms, spyware, etc.), the security of your Terminal and your network remains your responsibility. We recommend that you have an up to date anti-virus on your Terminal, do not let anyone access your wired or wireless home network or WIFI and check that your communications with the Internet are legitimate. You can also install a firewall on your computer.
IV - 3. Identity theft / Phishing
Because SCB Group does everything possible to offer you a safe browsing experience on the Site, you will never be asked for your username and password. SCB Group will never send you an email to ask for Personal Data or financial information. You should only provide your account information after logging on to the Site directly through your browser.

If you receive an email from SCB Group that you think is fraudulent, let us know by forwarding it to: spoof@scbmarket.com . We work with the competent authorities to arrest and prosecute fraudsters and identity thieves.
If you suspect that your SCB Group account has been spoofed, contact our Member Relations Department as soon as possible, from Monday to Friday from 7am to 8pm and Saturday from 9am to 5pm: In case of fraud concerning your credit card, please contact your bank.
V - Security of online payments
The Site uses one of the most effective security systems at the present time. SCB Group has not only adopted the SSL (Secure Socket Layer) encryption process but has also strengthened all scrambling and encryption processes for the best possible protection of all so-called "sensitive" Data related to means of payment.
For the security of transactions, SCB Group uses the Sogenactif system, developed by Société Générale (https://www.societegenerale.com/sites/default/files/documents/charte-donnee-groupe-societe-generale.pdf), the Mercanet system developed by BNP-Paribas (https ://mabanque.bnpparibas/rsc/contrib/pdf/Charte-donnees-personnelles.pdf), and the be2bill system developed by Dalenys (https://www.dalenys.com/mentions-legales/).
When paying on the Site, your bank details are encrypted on your Terminal, then transmitted in unintelligible form to servers which are solely capable of decrypting them. The authorisations and data are then checked with your bank to prevent abuse and fraud.

This process is based on the HTTPS protocol (implementation of SSLv3 or TLSv1 on HTTP), currently one of the most robust.
During transfers via the Internet, it is therefore impossible to read them: no unencrypted information passes through the Internet or mobile telecommunication networks.

When paying, you have the possibility of saving the details of your credit card to facilitate your future purchases on our Site. We collect your express consent for this purpose, in accordance with the recommendations of the CNIL.
This information is collected, stored and secured only by our Partners subject to the "PCI-DSS" (Payment Card Industry Data Security Standard).
The rules for using bank cards require banks domiciled in France to cover the risk of fraudulent use of your card.
We remind you that you must notify any fraudulent transaction to your bank or issuer of your card as soon as possible.
Express payment
Société Générale, BNP-Paribas and Dalenys have been chosen by SCB Group, with which you perform your purchase on the Site so that, if you wish, your credit card Data can be stored in a secure manner and used for future payments on our Site.

Société Générale and BNP-Paribas collect the Data relating to your credit card (card number and expiry date) to facilitate your future payments on our Site. This Data is not intended to be used for commercial prospecting purposes. It may be communicated to us, as necessary, with regard to the purpose mentioned above and to the subcontractor(s) of Société Générale and/or BNP-Paribas established in the European Union.
The Data transfers made necessary take place in conditions and with safeguards to ensure the protection of your Personal Data.

SCB Group is present on the Social Networks. In particular, we have our Facebook, Twitter, YouTube, Instagram, etc. web pages, whether fan pages or dedicated applications. We remind you that access to these Social Networks requires your acceptance of their contractual conditions containing provisions relating to the Personal Data Regulations for the processing they perform, irrespective of our pages on said Social Networks.

In order to enable you to register or connect more easily to our Site, you have the possibility to authenticate yourself on our Site via the account of a Partner Social Network. VII - "Cookies"
